Terms and Conditions of Sale
1. Overview:
The present document constitutes the general terms and conditions of sale governing the use of the Emerys website (https://www.emerald2k.com), as well as the purchase of second-hand clothing and accessories offered by the Emerys company.
By placing an order, the purchaser declares that he/she has read these terms and conditions of sale and accepts them unreservedly.
Throughout the site, the terms "we", "us" and "our" refer to Emerys.
2. Company identification:
Emerys is a company registered with the Nice Chamber of Commerce under SIRET number 89047201200024. Its head office is located at Rue du Parc, Distroff, FRANCE.
3. Products:
Each item available on the site is unique, as they are second-hand products. All items offered are second-hand and have already had a previous life. We strive to provide detailed and accurate descriptions for each item to give our customers a clear idea of its condition, features and appearance. However, as these are pre-owned items, it is important to note that signs of natural wear may be present, or slight variations/alterations in color may occur due to previous use. We are committed to providing the most accurate descriptions possible so that our customers can make an informed decision before placing an order.
4. Order:
The buyer may place orders on the Emerys website 24 hours a day, 7 days a week. For the order to be validated, the buyer must make payment and accept these terms and conditions of sale. The buyer must also provide a valid and accurate delivery address.
The sale is concluded as soon as the seller sends the buyer an order confirmation, generally by e-mail, after receipt of full payment of the price of the item, shipping costs and verification of contact details.
Any order implies acceptance of the item description and the price indicated in the sales catalog.

5. Delivery:
Emerys offers free delivery for all orders of 70 euros or more in France. Items offered on the site can be shipped within France as well as internationally. However, delivery costs may vary according to the buyer's geographical zone. We undertake to dispatch items as quickly as possible to the address given by the purchaser at the time of ordering. It is the buyer's responsibility to ensure that this information is correct.
6. Shipping times:
Once your details have been validated, packages will be dispatched within 3 to 6 working days in France by La Poste, depending on the weight of the item. For international deliveries, the carrier (La Poste) may require an additional 7 to 10 days. Each order will be accompanied by a tracking number sent to the buyer by email on the day of shipment.
Although we endeavor to dispatch all orders within the times stated, Emerys declines all responsibility for unforeseen circumstances arising after the items have been dispatched. Risk in the items passes to the purchaser as soon as they leave our premises.
7. Receipt:
If the product(s) received do not meet the buyer's expectations, the buyer has the right to return the order by sending an e-mail to the following address: contact.emerys@gmail.com. Customers have 14 days from receipt to return the product. Returns will only be accepted if the product is in its original condition and at the buyer's expense.
Any claim made after this period will not be accepted, except in the case of non-compliance with delivery deadlines by the seller.
For international orders, Emerys is not responsible for any customs fees, local taxes or import duties. These costs are borne exclusively by the buyer, who is responsible for importing the items ordered into his or her country.
8. Return policy:
In accordance with current legislation, the purchaser has a 14-day cooling-off period from receipt of the order to request its return.
The return of the parcel is at the buyer's expense and risk. No compensation will be paid by Emerys in the event of loss or damage to the parcel during the return process. Once the item has been received by the seller, and if it conforms to the advertisement, the seller will refund the full price of the item, less the initial shipping costs. Any returned item showing signs of use, testing or wear not initially mentioned in the advert will be considered invalid and non-refundable.
Return shipping costs are at the buyer's expense, and the parcel must be returned by the shipping method chosen when the order was placed.
9. Prices:
Prices are indicated in euros and do not include delivery charges, which are invoiced in addition and mentioned before the order is validated.
The prices of our products are subject to change without notice.
We reserve the right to modify or discontinue the service (or any part or content thereof) at any time without notice.
We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the service.
10. Payment methods:
The buyer may pay for his order by choosing from the various payment methods offered on the Emerys website.
11. Disputes:
In the event of a dispute arising from this contract, the purchaser is invited to seek an amicable solution before taking any legal action. The buyer undertakes to meet its financial obligations to the seller and to comply with all the provisions set out in this contract.
All complaints will be treated sympathetically if they are made in good faith. In the event of a dispute, the customer must first contact Emerys to attempt to resolve the dispute amicably.
12. Protection of personal data:
Emerys is committed to protecting the privacy of its customers. The data collected at the time of the order is used solely for the purpose of processing the order and the commercial relationship between Emerald2K and the buyer.

13. Applicable law and jurisdiction:
These terms and conditions are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
14. Intellectual property rights:
All content on the Emerys website, including images, text and logos, is protected by intellectual property laws. Any unauthorized reproduction, distribution, modification or use of the site content is strictly prohibited without the prior written permission of Emerys.
15. Changes to the GTC:
Emerys reserves the right to modify these terms and conditions at any time. The new terms and conditions will apply to all orders placed after their publication on the website. The buyer is advised to consult the GTC regularly to take note of any updates.
